Jackson shows signs of flexibility on fixed costs.

As the costs management regime shows signs of working well, Lord Justice Jackson seems prepared to accept that a more flexible approach to fixed costs is required. He now proposes an intermediate track for lower value multi-track cases be trialled on a voluntary pilot scheme. He recognises that ‘lower value’ has different meanings in different types of cases and the value of a claim should not be the only measure, as fixed costs may not be suitable in the more complex lower value cases.
